Madras High Court Rules Father’s Name Not Mandatory in Birth Certificates for Single Mothers

In a landmark judgment that brings major relief to single mothers, the Madras High Court has ruled that it is not mandatory to mention the father’s name in a child’s birth certificate when the mother is raising the child alone.

The case was filed by a divorced woman from Tiruchirappalli, who wished to have a child of her own and underwent artificial insemination with the help of a sperm donor. She later gave birth to a baby girl. However, while applying for the child’s birth certificate, municipal authorities insisted that the “father’s name” column must be filled.

When she approached the Tiruchirappalli Corporation seeking relief, officials reportedly advised her to include the name of the sperm donor. Opposing this, the woman moved the Madras High Court, requesting that only her name as the single parent should be sufficient for the birth certificate.

Hearing the petition, Justice M.S. Ramesh delivered a historic ruling, stating that there is no legal requirement to compel a single mother to disclose the father’s identity while registering the birth of her child. The court observed that in cases where the child is raised solely by the mother—whether due to separation, abandonment, donor conception, or the father’s absence—the mother’s name alone is enough in official records.

The court further clarified that this principle would also apply to school admissions, property registration, and other official documentation, ensuring that children raised by single mothers are not subjected to unnecessary hardship.

The judgment is being widely welcomed as a progressive step toward recognising single parenthood and strengthening the right to use the mother’s name or initials in official documents, especially in societies where women are often abandoned, widowed, or choose motherhood independently.

This verdict is expected to offer a new sense of dignity and legal protection for countless single mothers and their children across India.
