HRCSL Summons Three Northern Education Officials Over Alleged Fundamental Rights Violation

The Human Rights Commission of Sri Lanka (HRCSL) has issued summons to three senior officials from the Northern Province in connection with an alleged violation of fundamental rights linked to a teacher transfer dispute.

The summons follows a complaint previously lodged with the Commission regarding a transfer decision that had been temporarily suspended, citing service requirements. Based on this complaint, the HRCSL has called for an inquiry into whether the decision violated constitutionally guaranteed rights.

Accordingly, the Secretary to the Northern Province Ministry of Education, the Provincial Director of Education, and the Secretary of the Public Service Commission have been instructed to appear before the HRCSL headquarters on April 28, 2026, at 11:00 a.m. The hearing will take place in Room No. 05 on the 7th floor of the Commission’s head office.

The notice requires the officials to present all relevant documents and information related to the case.

In its communication, the HRCSL emphasized that under Section 20(3) of the Human Rights Commission of Sri Lanka Act No. 21 of 1996, any individual issued with a summons is legally obligated to appear before the Commission at the specified time and place. They are also required to respond to questions posed and submit any documents or materials requested by the Commission.

Furthermore, under Sections 20(2) and 21(3) of the Act, failure to appear without valid reason, refusal to answer questions, non-compliance with written orders, or failure to produce requested documents may be treated as contempt of the Commission.

Such acts of non-compliance are considered equivalent to contempt of the Supreme Court of Sri Lanka and may be subject to penalties under Section 21 of the Act, the Commission warned.

The inquiry is expected to examine whether administrative actions taken in the teacher transfer process infringed upon fundamental rights protected under the Constitution.
